Welcome to Squishmees! Throughout these Terms of Service, “Squishmees,” “we,” “us,” and “our” refer to the business operating https://squishmees.com.

Squishmees is a Canadian business specializing in handmade crocheted plushies, including ready-to-ship, made-to-order, and personalized creations. Our online store is powered by Shopify.

These Terms of Service (“Terms”) describe the conditions governing your access to our website, use of its features, and purchase of our products.

By accessing our website or placing an order, you agree to these Terms and the policies referenced within them, including our Privacy Policy, Shipping Policy, and Return & Refund Policy.

Please read these Terms carefully. Nothing in these Terms excludes or limits any consumer rights, warranties, protections, or remedies that cannot legally be excluded or limited under applicable law.

1. Eligibility and Customer Accounts

By making a purchase, you confirm that you are legally capable of entering into the transaction or have the necessary permission from a parent or legal guardian.

You agree to provide accurate and complete information when creating an account or placing an order, including your contact details, billing information, shipping address, and payment information.

You are responsible for maintaining the confidentiality of your account credentials and notifying us if you suspect unauthorized activity.

We may restrict access to accounts where reasonably necessary to address fraud, security threats, or violations of these Terms, subject to applicable law.

2. Our Handmade Products

Every Squishmee is individually crocheted by hand in Canada.

Because our products are handmade, minor differences in stitching, shape, measurements, yarn texture, and placement of details are normal. These natural variations contribute to the individuality of each creation.

We make reasonable efforts to ensure that product descriptions, measurements, photographs, and colour representations are accurate. However, colours may appear slightly different depending on your display settings, lighting, and the yarn used.

Handmade variations do not remove your rights if an item is defective, materially misrepresented, or different from what you ordered.

Product descriptions identify the materials, available choices, approximate dimensions where provided, and any important safety considerations.

We reserve the right to discontinue designs or change available materials, subject to fulfilling accepted orders and applicable consumer protection requirements.

3. Ready-to-Ship Products

Ready-to-ship Squishmees are finished plushies that have already been handmade and are available for purchase.

These products are generally included in our Fresh Off the Hook collection or otherwise identified as Ready to Ship.

Finished items that are in stock are normally prepared and dispatched within 1–5 business days after an order is placed.

Processing times exclude weekends and statutory holidays. Shipping transit time is additional.

The specific colour combination and design photographed or described on the listing represent the finished item being purchased, subject to any clearly disclosed variations.

Ready-to-ship products are subject to our eligible 14-day voluntary return policy, as explained below.

4. Made-to-Order and Personalized Products

Made-to-order Squishmees are created after a customer places an order.

Where available, customers may personalize their plushie by selecting yarn collections, colours, and designated design details through the customization options on the product page.

Production normally takes approximately 5–7 business days, unless a different timeframe is stated on the product listing or agreed upon for a special order.

These production times are estimates and do not include shipping transit time.

The photographs accompanying made-to-order products are examples of completed creations. Your finished Squishmee will reflect the customization choices submitted with your order, subject to normal handmade variations.

If a selected yarn colour or required material becomes unavailable, we will contact you to discuss suitable alternatives before proceeding.

If an acceptable alternative cannot be agreed upon, we will arrange an appropriate cancellation or refund in accordance with applicable law.

Because these products are personalized or made specifically for a customer, they are generally not eligible for voluntary change-of-mind returns. This does not limit statutory cancellation rights or remedies for faulty, incorrect, or misdescribed products.

5. Orders and Acceptance

Submitting an order constitutes an offer to purchase the selected products.

Order acceptance is subject to successful payment processing and our ability to fulfill the order.

We may contact you to clarify customization choices, delivery information, or other details necessary to complete your purchase.

We reserve the right to decline or cancel an order for legitimate reasons, including:

• Product or material unavailability.

• Significant pricing or listing errors.

• Inability to complete the requested customization.

• Suspected fraudulent or unauthorized transactions.

• Circumstances preventing reasonable fulfillment.

If an order is cancelled after payment has been collected, we will notify you and provide the appropriate refund in accordance with applicable law.

Customers are responsible for reviewing their order details, including customization choices and shipping information, before completing checkout.

Changes or cancellations may be more difficult once production has begun or an item has shipped. Any applicable statutory cancellation rights remain unaffected.

6. Prices, Currency and Payments

Squishmees operates from Canada, and our product prices are generally established in Canadian dollars (CAD).

Where supported, the storefront may display prices in U.S. dollars (USD). The currency and total amount shown at checkout identify the payment being authorized.

Product prices, availability, promotions, and discounts may change without notice. Changes will not ordinarily affect an order that has already been accepted, except as permitted by applicable law.

Shipping charges and applicable taxes calculated by the store are displayed during checkout.

Orders shipped to the United States may be subject to customs duties, import taxes, brokerage fees, or other charges. Amounts collected at checkout will be identified there. Additional charges may arise where they are assessed by authorities or carriers and are not collected in advance.

Customers should review their order totals and any disclosed potential charges before completing their purchase.

Payments are processed through the secure payment methods offered by Shopify Checkout and its payment providers.

We do not require customers to provide payment-card information directly by email.

7. Shipping and Delivery

Squishmees currently ships to Canada and the United States, primarily using Canada Post.

Our standard estimated shipping transit times, after dispatch, are:

• Canada: approximately 3–5 business days.

• United States: approximately 5–10 business days.

Actual delivery times depend on the destination, shipping method, carrier operations, customs processing, weather, and other circumstances.

Transit estimates are not guaranteed delivery dates.

For orders containing both ready-to-ship and made-to-order items, we normally dispatch the entire order together when all products are ready.

Available shipping methods and rates are displayed during checkout.

Shipping confirmations and tracking details are provided when the selected shipping service supports tracking.

Customers are responsible for providing accurate and complete delivery information.

If your parcel is delayed, damaged, missing, or delivered incorrectly, please contact us so that we can investigate and assist with an appropriate resolution.

Carrier disruptions or events outside our reasonable control may cause delays. However, delivering an order to a shipping carrier does not automatically eliminate our responsibilities or your statutory rights concerning delivery, non-delivery, damaged goods, or other protected circumstances.

Risk of loss, delivery responsibilities, and available remedies remain governed by applicable law.

8. Returns and Refunds

We want customers to shop with confidence and understand their options before purchasing.

Ready-to-Ship Products

We accept voluntary change-of-mind return requests for eligible, unused ready-to-ship Squishmees within 14 calendar days of delivery.

To qualify for a voluntary return, an item must generally be unused and in the condition in which it was received.

Please retain the original packaging where reasonably possible and provide your order number or other proof of purchase.

Customers must contact us before sending an item back so we can provide return instructions.

For voluntary change-of-mind returns, the customer is generally responsible for return shipping costs.

Original shipping charges are generally non-refundable for voluntary change-of-mind returns, except where required by law.

Made-to-Order and Personalized Products

Made-to-order, custom, and personalized Squishmees are generally not eligible for voluntary change-of-mind returns.

This exclusion does not apply where a customer has a return, cancellation, refund, or other right under applicable law.

Damaged, Defective or Incorrect Products

If an item arrives damaged, defective, or different from what you ordered, contact us promptly.

We appreciate receiving reports within seven days of delivery where possible, but this request does not restrict any statutory rights.

Please provide your order number and photographs where practical so we can assess the issue.

Depending on the circumstances and applicable law, an appropriate remedy may include repair, replacement, refund, or another legally required resolution.

Refund Processing

Once an authorized return has been received and inspected, we will notify you of the outcome.

Approved refunds are generally processed to the original payment method within 5–10 business days of processing. Additional time may be required by your financial institution.

9. Product Safety

Squishmees are handmade crocheted plushies, and safety considerations vary by design.

Some products feature plastic safety eyes or other small components that may present a choking hazard if detached.

Products containing these components are not suitable for children under three years of age.

Adult supervision does not eliminate the risk presented by detachable small parts.

Customers should review the age and safety information displayed on each product page.

Inspect plushies regularly for loose or damaged components. Discontinue use if stitching becomes damaged or any component becomes loose.

Do not allow children to use a damaged plushie.

Customers are responsible for considering the intended recipient's age, abilities, and relevant safety needs when selecting a product.

Nothing in this section removes any product-safety responsibilities imposed on Squishmees by applicable law.

10. Product Care

Unless the individual product listing specifies otherwise, we recommend gently spot-cleaning Squishmees using a damp cloth and mild soap.

Avoid machine washing, machine drying, bleach, and harsh cleaning products, as these may damage yarn fibres, stuffing, stitching, or decorative components.

Allow cleaned plushies to air dry thoroughly.

Customers should follow any additional product-specific care instructions provided with their purchase.

11. Intellectual Property

The original Squishmees brand name, logos, photographs, written descriptions, website graphics, and other original business content are protected by applicable intellectual property laws.

Customers may not reproduce, distribute, or commercially exploit our original website content without authorization, except where permitted by law.

Some Squishmees products are created using crochet patterns designed by independent artists.

These designers retain ownership of their respective pattern designs and other applicable intellectual property.

Where appropriate, the original pattern designer is credited on the product listing.

Purchasing a finished plushie does not transfer ownership of the underlying pattern or grant permission to reproduce a protected design.

Shopify and other third-party names, logos, trademarks, and materials remain the property of their respective owners.

12. Optional Third-Party Tools

Our website may use services or tools provided by third parties, including product customization apps, customer reviews, payment solutions, analytics, and shipping integrations.

These services may have separate terms, conditions, and privacy notices.

We make reasonable efforts to use suitable providers, but cannot guarantee uninterrupted availability of third-party services.

Where third-party functionality experiences technical issues, we will take reasonable steps to assist customers with affected orders.

Nothing in this section limits obligations or liabilities that cannot legally be excluded.

13. Third-Party Websites and Links

Our website may contain links to external websites, platforms, social media accounts, and services operated by third parties.

We do not control the content, security, availability, or privacy practices of unrelated websites.

Customers should review the terms and privacy policies of external services before using them.

A link to another website does not necessarily represent an endorsement of everything on that website.

14. Relationship with Shopify

Squishmees uses Shopify to host and operate our online store.

Shopify provides technology supporting product browsing, checkout, payment processing integrations, and other ecommerce functions.

Unless otherwise stated, purchases made through Squishmees are transactions between the customer and Squishmees, not between the customer and Shopify.

Shopify and its affiliates have their own applicable terms, responsibilities, and legal protections.

Nothing in this section limits responsibilities or consumer rights imposed by applicable law.

15. Privacy and Personal Information

We collect and use personal information as necessary to operate our business, process transactions, fulfill orders, communicate with customers, and provide applicable services.

Shopify and certain third-party providers may also process information in connection with these activities.

16. Customer Reviews, Feedback and Submissions

Customers may voluntarily submit product reviews, photographs, suggestions, comments, or other feedback.

By submitting content for publication through our store or review features, you confirm that you have the necessary rights to share it.

You grant Squishmees a non-exclusive, worldwide, royalty-free licence to reproduce, display, adapt for formatting, and use the voluntarily submitted content in connection with operating, improving, and promoting our business, subject to applicable privacy and other laws.

We may moderate or remove reviews and submissions that are unlawful, fraudulent, abusive, misleading, or otherwise violate applicable policies.

Customers must not impersonate others, infringe intellectual property rights, or submit malicious or unlawful material.

Private customer-service correspondence is not automatically treated as publicly submitted marketing content.

We do not guarantee that every submitted review or suggestion will be published or receive a response.

17. Errors and Inaccuracies

We make reasonable efforts to maintain accurate product listings, prices, descriptions, shipping information, and website content.

Occasional errors, omissions, technical issues, or inaccuracies may occur.

Where a material error is discovered, we reserve the right to correct the information and, where justified and permitted by law, contact the customer about an affected order or cancel an order that cannot reasonably be fulfilled as described.

Where payment has been collected for a cancelled order, we will provide the appropriate refund required by law.

Such action will not automatically cancel our obligations concerning valid orders already accepted.

Provisions that by their nature remain relevant after termination, including intellectual property, privacy, dispute resolution, and lawful limitations of liability, may continue to apply where permitted.

21. Website Availability and Warranties

We aim to provide accurate information and a functional shopping experience.

However, websites and digital services may occasionally experience interruptions, maintenance, technical difficulties, or temporary unavailability.

We do not guarantee that access to the website will always be uninterrupted or error-free.

To the extent permitted by applicable law, website functionality is provided on an “as available” basis.

Nothing in these Terms excludes mandatory product-quality protections, legal warranties, consumer guarantees, or statutory rights applicable to purchased goods.

22. Limitation of Liability

To the extent permitted by applicable law, Squishmees is not responsible for losses arising solely from events outside our reasonable control, unauthorized use of customer accounts, or unrelated third-party services over which we have no control.

We do not seek to exclude or limit liability for defective products, non-delivery, misrepresentation, personal injury, statutory obligations, or other circumstances where exclusion or limitation is prohibited by law.

Any otherwise applicable limitation of liability shall operate only to the extent permitted by law and shall not remove a customer's legally protected remedies.

23. Indemnification

To the extent permitted by applicable law, a person who unlawfully misuses our website or infringes another party's rights may be responsible for resulting third-party claims, losses, or reasonable expenses directly attributable to that conduct.

Nothing in this section requires a customer to indemnify Squishmees or Shopify for our own unlawful conduct, negligence, or responsibilities that cannot legally be transferred to the customer.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the extent necessary without automatically invalidating the remaining provisions.

Mandatory consumer protection and other applicable statutory rights take precedence over conflicting contractual terms.

25. Entire Agreement and Waiver

These Terms, together with the policies expressly incorporated by reference and the applicable order details, describe the conditions governing use of our website and purchases from Squishmees.

Product-specific customization instructions, shipping disclosures, and other material terms presented before purchase also form part of the relevant transaction where applicable.

Failure to enforce a provision on one occasion does not necessarily waive our ability to enforce that provision in other lawful circumstances.

Nothing in this section overrides applicable statutory rights or required pre-contract disclosures.

26. Assignment

Customers may not transfer their accounts or contractual obligations to another person without appropriate authorization where required.

Squishmees may transfer its contractual rights or responsibilities as part of a legitimate business transaction, subject to applicable law and the preservation of customer rights.

Any transfer will not eliminate legally enforceable obligations to customers.

Squishmees operates in Alberta, Canada.

Subject to mandatory laws and consumer protections that apply in a customer's jurisdiction, these Terms are governed by the laws of Alberta and applicable federal laws of Canada.

Nothing in these Terms requires customers to surrender legally protected court access, cancellation rights, statutory remedies, or other rights that cannot be waived.

28. Languages and Interpretation

These Terms may be made available in languages other than English.

Where translations differ, the English version may be used to interpret the intended meaning, except where applicable law requires a different result.

Section headings are provided for convenience and do not independently change the meaning of the Terms.

29. Electronic Communications

By using our website or placing an order, you acknowledge that we may send order confirmations, service messages, payment notices, shipping information, and other transaction-related communications electronically.

Marketing communications will be managed in accordance with applicable consent and privacy requirements.

Customers may unsubscribe from optional marketing emails using the unsubscribe method provided.
